These conditions of sales, detailed below, govern the sale of the products presented on the

By confirming his order, the user accepts, these general conditions of sale.
The website editor keeps the right to modify or to adapt these general conditions of sale
whenever he wants.

In that case, the conditions will be the ones in operation at the date of the order.
It is agreed that the contract is subject to french law which is applicable in French Polynesia.
Products are offered for sale from French Polynesia.

Regarding the items out of stock, you can request to be notified of their availability by email.
The consumer has the ability to save or edit these general conditions, being understood that
he will be responsible for saving or editing this document.

DESCRIPTION AND AVAILABILITY OF THE PRODUCTS

Products we sell on the website are offered within the limits of the available stocks.
When ordering, we will inform you of the products availability you want to buy.
However, if products are temporarily unavailable (out of stock, end of production, etc.. ) after ordering,
we'll inform you by email and we'll invit you to cancel or modify your order.
If the products are permanently unavailable after ordering, we will automatically cancel your
order and notify you by e-mail.

Our jewelry with Tahitian black pearls are unique items because each pearl is different, by its
color, shape and size.

The photos in the catalog are as accurate as possible but can not be exactly similar with the
ordered product, particularly for the color of pearls.

Our photos are not contractual.

Furthermore, our responsibility can not be held if errors are introduced in the product
descriptions, despite all our good will.
Before you order, you have the possibility to read the details of the product which interest
you, and/or to contact us at : contact@bijouteriedeperles.fr.

ORDERS

The buyer, who wishes to buy a product must :
- fill his basket by selecting the wanted product(s) by using "Add", then "Order" button
- complete the identification form which indicates all the information needed
- confirm his order after verification
- pay in the intended conditions
A confirmation of order will be sent by email. It will contain a summary of your order.

Price

Prices don't include delivery fees, charged extra, and indicated before the validation of the
order.
These shipping costs can't be a valid reason to challenge the order after the final registration.
Prices are quoted in Euros or in US Dollars and in duty free.

We keep the right to modify the prices at any time, but the real prices for your order
will be the prevailing prices at the validation of the order, subject to availability.
Products sold to export (France included) are duty free purchases.

Regarding international shipping, you may have fees to pay at the receipt of your package.
These taxes, which depend on the country of delivery, remain the responsibility of the
customer.

The Black Pearl Center can not inform you on the amount of these taxes.
You must pay the total amount of your order when ordering on the website.
The invoice include the price of each product.

PAYMENTS SECURITY

All our products are payable in cash. Online payment is secure and is done with Paybox.
With Paybox, BLUE CARD, VISA, MASTER CARD and AMERICAN EXPRESS (and others) are accepted.
Confidential data (card number with 16 digits, expiration date) does not pass nor are stored on
the servers of The Black Pearl Center.
The shop can not read the card numbers.

SHIPPING AND DELIVERIES

Orders are prepared and shipped within 2 business days after ordering.
Your orders are shipped using the French postal service.
In general, delivery times are between 8 and 15 days after shipment
Pursuant to Article L121.20.3 of the Consumer Code, the ordered products will be delivered
within a maximum period of thirty days from the following day after the consumer has
confirmed and payed his order.

At the end of this period, if the buyer has not received his package he will be able to cancel his order.
We will return back to the buyer what he has paid, without delay, except all other compensation.
The products will be shipped to the specified address on the customer's order form.

Like in any expedition, there may be a delay of delivery or the product can get lost.

In case of late delivery from the date we've shown in the mail from,
we ask that you notify us of the delay in sending us an email.

In case of late delivery from the date indicated in the email we sent the day of shipping,
we ask you to send us an email. We'll contact the carrier to start an investigation.

An investigation may take up to 21 days from the day of its beginning.

If during this period the product is found, it will immediately re-routed to your home.

However, if the product is not found at the end of the period of 21 days of investigation it will
be considered as lost.

PERIOD OF RETURN

Under the conditions of Article L121-16 of the Consumer Code and in the context of distance selling,
the buyer has a withdrawal period of 7 clear days from the delivery of his order.

For any returned merchandise, you must send an email to contact@bijouteriedeperles.fr.
The return of goods is at the expense and risk of the buyer to :

Buyers who have returned their product may ask the reimbursement that The Black Pearl Center
will do within 30 days after sending the confirmation of receipt of the product to the customer.

The consumer will then be refunded by crediting his bank account (secure transaction).
We will only take the products which will be sent back in their original packaging, complete and
intact, and in perfect condition for resale.

Any product that has been damaged or whose original packaging has been damaged, will not be refunded or exchanged.

Furthermore, the product must not have been used improperly, excessive or inconsistent
with the purpose for which it was intended, and generally, the product must be in good
condition.

The Black Pearl Center keeps the right to determine if all these conditions are fulfilled.

When the returned product by the customer will be received, The Black Pearl Center will send
an email of confirmation.

COURT ATTRIBUTION CLAUSE

Any disagreement between the parties that could not lead to a settlement will be subject to
the jurisdiction of the Commercial Court of Papeete,
French Polynesia in whose jurisdiction the enterprise is registered.

APPLICABLE LAW

In case of dispute or claim, the buyer will contact in priority the company The Black Pearl
Center, for an amicable solution.
These general conditions of sale are governed, as to their interpretation than their execution,
by the French Law applicable in French Polynesia.

PERSONAL INFORMATION PROTECTION ACT

According to the law dated 6th january 1978 relating to Computers, Security and Liberties,
amended by Act No. 2004-801 of August 6, 2004, the automated processing of personal data
made from the website www.cicorella.fr has been a statement from the National Commission
Information Technology and Freedoms,
recorded statement on 01/07/2009 under No. 1373710.
Client's personal data (first name, last name, company name, personal addresses or electronic,
telephone numbers, fax numbers) are collected by the company for the purposes of good management of orders, 
shipments and invoices.

According to the Data Protection Act n° 78-17 of January 6, 1978, the client has, at any time,
the possibility of access, modification or delete his personal information.

The Black Pearl Center commits itself not to resell or convey its information to anybody without
the client’s consent.

The Black Pearl Center makes use of different means to prevent from the risks linked with
computing and make the internet surfer pay attention about the obvious risks they may encounter about
the data privacy that transit via the network and accept no liability about the running risks.

WARRANTIES

You have a 7 days legal deadline from the date of delivery, to return back the product that
would not suit you.

We will only take the products which will be sent back in their original packaging.
Any product that has been damaged or whose original packaging has been damaged, will not
be refunded or exchanged.
